These Terms govern your use of fundamenta.agency (the “Site”), operated by Fundamenta, a proprietorship (“Fundamenta”, “we”, “us”, “our”), based in Pune, India.

These Terms cover use of the website. They do not govern any paid engagement. A separate written proposal or contract governs any services we deliver. Where the two differ on the services, the signed contract wins.

When you send an enquiry, request a Brand Trust Audit, subscribe, or apply for a role, you agree that the details you give are accurate and that you may share them. We handle that data under our Privacy Policy.
A free resource such as the Brand Trust Audit is provided for your information. It is a diagnostic view, not a guarantee of any result. It does not create a client relationship on its own. A client relationship begins only when both sides sign an engagement.
3. Intellectual property
The Site, its content, design, copy, marks, frameworks, and the Fundamenta name and logo are owned by us or our licensors and are protected by law. The work we publish in our portfolio remains our intellectual property or our clients’, as agreed.
You may view and share Site content for your own non-commercial reference, with attribution. You may not reproduce, republish, sell, or build on our content, frameworks, or designs for commercial use without our written permission.
Any feedback you send us about the Site may be used by us without restriction or obligation to you.
4. Client work shown on the Site
Case studies and portfolio work are shown with the relevant client’s awareness. Figures, outcomes, and quotes reflect what was reported to us at the time and are shared in good faith. They describe past projects and are not a promise of similar outcomes for any future engagement.

The Site may link to other websites and platforms we do not control. We provide those links for convenience. We do not endorse them and are not responsible for their content, practices, or any harm from using them. Use them at your own risk and read their terms.

This clause does not affect the separate liability terms in any signed services contract, which govern that work.

10. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Pune, Maharashtra, India have jurisdiction over any dispute, subject to any right you have under the mandatory consumer or data law of your own country.
If you use the Site from outside India, you do so on your own initiative and are responsible for complying with your local law.
